Terms of Use

Welcome to MedQuest, L.T.D.

By using our website and/or using the services that are provided, you acknowledge that you have read, understood, and agree to be bound by our Terms and Conditions (“T&C”) governing the use of this Service and the agreement that operates between You and MedQuest, Ltd. Your access to, and use of, the Service is conditioned upon your acceptance of and compliance with these T&C. MedQuest, Ltd. recommends that you save or print a copy of these Terms and Conditions for future reference.

Full Terms

1. Payment

MedQuest, Ltd. accepts payments via ACH, wire, check, cashier’s check, or credit card.

Payments by credit card or wire transfer will be made via our payment portal. (Link to be provided after ordering).

Payments by ACH can be made by calling our office at 212-725-8000, ext. 111.

Payments by check or cashier’s check can be made by mailing the check to:

Please note for SettlementPay℠ applications - Payment is not contingent upon, nor due upon settlement or verdict in your case unless you have been approved for funding, and the contract for funding has been executed by all parties, for SettlementPay℠. Otherwise, all payment terms herein apply unless approved in writing by a SettlementPay℠ representative.

Prepayment is required for Medical Opinion Orders, Cost Projection Reports, and for larger Orders, including those requiring more than 60 hours of time.

Any order not requiring prepayment, payment is due upon receipt of Invoice and is considered past due 30 days thereafter.

An invoice is considered delivered to the You/Client/Firm/Attorney on the date that MedQuest sends an email to the person or email address listed when placing the Order. You, the Client, the law firm, and Attorney are responsible for informing MedQuest if they wish the Invoice to be emailed to an additional email other than that of the person who placed the Order. The date MedQuest emails the Invoice to the ordering party’s email is the date of Invoice Delivery.

2. Delivery Dates

Any order that has a delivery window on which that date lands on a weekend or holiday, the product/service will be delivered on the next business day.

3. Authorization

By electing to place an order with MedQuest, Ltd., you represent, warrant, and covenant that you are authorized, and have full power and authority to transact business on behalf of the attorney listed, any attorney of record relating to the file/record placed, the law firm for which any attorney so listed is associated, and the managing partner(s) of the law firm. You represent, warrant, and covenant that you are authorized to bind the all the persons and entities above to the stated terms and conditions herein this page. If order is placed for/by a Medical Expert, you represent, warrant, and covenant that you are authorized, and have full power and authority to transact business on behalf of that Medical Expert and company/organization for which Medical Expert is employed.

4. Responsible Party

You are responsible for all orders placed with MedQuest, Ltd. As similarly specified within the definition section above, the Responsible Party(s) includes the attorney listed on the order, any attorney of record relating to the file/record placed, the law firm for which any attorney so listed is associated, and the managing partner(s) of the law firm. If the Law Firm and Attorney part ways before payment is made, all listed parties are, and remain jointly and severally responsible for payment of any invoices. Likewise, if a different Attorney takes over a case related to an invoice (future attorney of record), the original ordering Attorney, current attorney of record, and all future and subsequent attorney of records are all jointly and severally liable for the invoices. The foregoing applies to Medical Experts and their companies/organizations similarly and equally.

5. Limitation of Liability

In no event will MedQuest, Ltd. be liable for any claims asserted by any law firm or attorney or medical expert under any legal theory for lost profits, lost revenues, lost business opportunities, exemplary, punitive, special, incidental, indirect, or consequential damages, each of which is waived by both the law firm and attorney and medical experts. You understand that we do not provide legal advice and the outcome of your case is the responsibility of you alone.

MedQuestLtd.com Website is provided “as is,” with all liabilities, and MedQuestLtd.com makes no express or implied undertakings, representations, or warranties, of any kind related to this Website or the content contained on this Website.

MedQuest, Ltd. periodically changes, adds, modifies, improves, or updates this Website’s consent with or without prior notice. Under no circumstance shall MedQuest, Ltd. be liable for any loss, damage, injury, liability, or expense incurred or suffered from the use of this Website, including, without limitation, any fault, error, omission, commission, delay, failure, interruption, deletion, alteration, disruption, cessation or incursion concerning such use by us, our affiliates or any third party. Under no circumstance shall Company or any of its partners and affiliates be liable for any direct, indirect, consequential, accidental, or special damages, even if Company has been advised against the risk or possibility of such damages. You agree that MedQuest, Ltd. will not be liable for any conduct or behavior of the User arising from the use of this Website. As a result, the use of this Website and all or any of its content is at the User’s sole risk.

In no event shall MedQuest, Ltd., nor any of its officers, directors, employees, and affiliates, be liable for any loss, injury, or damage arising out of your use of this Website, whether, under contract, tort, or otherwise, and Company, including its officers, directors, employees, and affiliates shall not be liable for any indirect, consequential or special liability arising out of your use of this Website.

6. Termination

We may terminate or suspend your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions.

We reserve the right and sole discretion to, and without notice or liability, deny access to and use of the Website (including blocking specific IP addresses) to any user for any reason including but not limited to breach of any representation, warranty, or Agreement in these Terms or any applicable law or regulation.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your Account, you may simply discontinue using the Service.

The provisions of these Terms and Conditions shall remain in full force and effect while you use MedQuest, Ltd. and our services.

7. Indemnification

By placing an order with MedQuest, Ltd., You, the attorney listed on the order, any attorney of record relating to the file/record placed now or in the future, the law firm for which any attorney so listed is associated, and the managing partner(s) of the law firm each jointly and severally indemnify and hold harmless MedQuest, Ltd.’s officers, directors, and shareholders against all losses, damages, claims, liabilities, and expenses (including reasonable attorney and expert fees) incurred by Client resulting from (a) claims asserted of or relating to any case order placed with us (b) actions taken by any injured party in reliance upon information or opinions provided by you the Client, (c) use of this website including without limitation, any claim related to the breach of any of the provisions of these Terms and Conditions. For orders placed by or for a Medical Expert, the foregoing applies to the Medical Expert and their company/organization.

8. Default

You will be deemed in default of any invoice if you fail to pay the invoice within 30 days of delivery of the invoice. Any invoice over 30 days late will incur 1.5% compounded monthly interest as penalty. You agree that if MedQuest is required to enforce payment, You, attorney listed on the order, any attorney of record relating to the file/record placed, the law firm for which any attorney so listed is associated, and the managing partner(s) of the law firm, the medical expert or medical expert company, jointly and severally, are liable for all attorney’s fees, collection costs, and court costs to collect and enforce payment of the invoice. You agree that collection costs may include collection agency fees, which may include a contingency fee for up to 40% of the amount claimed, of which you agree such percentage rage is reasonable and expected, and collection costs will include interest and associated court costs. If MedQuest, Ltd. becomes entitled to the entry of judgment against you, the Client, then you agree to a post-judgment interest rate of 29.99% per annum upon entry of the judgment until satisfaction of the judgment.

9. NSF or Insufficient Funds

If any payment tendered by you is returned due to insufficient funds, you agree to immediately pay a fee of $50.00 or 5% of the amount of the check (whichever is greater) in addition to any other fees we have incurred for each dishonored check. Failure to pay this fee immediately shall be a material default and breach of this Agreement.

10. Personal Guarantee

By placing an order with us, You, the attorney listed on the order, any attorney of record relating to the file/record placed now or in the future, the law firm for which any attorney so listed is associated, and the managing partner(s) of the law firm, or for orders placed by medical experts, this includes the medical expert and their company/organization, does so irrevocably, absolutely, and unconditionally guarantee to MedQuest, Ltd. the full and prompt payment of all invoices and obligations of any order placed. That You, the attorney listed on the order, any attorney of record relating to the file/record placed now or in the future, the law firm for which any attorney so listed is associated, and the managing partner(s) of the law firm, or for orders placed by medical experts, this includes the medical expert and their company/organization, are personally responsible for any default and debt associated, and personally agree to all default provisions and remedies to collect any non-payment herein.

11. Privacy Policy

By using this Website and its services, you may provide us with certain personal information. By using MedQuestLtd.com or its services, you authorize us to use your information in any country or state that we operate in. We reserve the right to use such information to improve your user experience and facilitate mailing and traffic, and market analytics.

By accessing this Website, specific information about the User, such as Internet protocol (IP) addresses, site navigation, user software, and the surfing time, along with other similar information, will be stored on MedQuestLtd.com servers. Information about their identities, such as name, address, contact details, billing information, and other information stored on this Website, will strictly be used only for statistical purposes and will not be published for general access. MedQuestLtd.com, however, assumes no responsibility for the security of this information.

12. Modifications; agreements

No modification, amendment, waiver, or consent of any provision of these terms and conditions shall be effective unless the same shall be in writing and signed by all parties.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

14. Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Terms shall not effect a party’s ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.

15. Assignment

MedQuest, Ltd. reserves the right to assign, transfer, and subcontract its rights and/or obligations under this Agreement without any prior notification or consent required. Users shall not be permitted to assign, transfer, or subcontract any of your rights and/or obligations under these Terms. Furthermore, a person who is not a party to these Terms and Conditions shall have no right to enforce any provision contained therein.

16. Preservation of immunities

Nothing herein shall constitute a limitation upon the privileges and immunities of MedQuest, Ltd., which are specifically reserved.

17. Entire Agreement

These Terms and Conditions, including any legal notices and disclaimers on this Website, constitute the entire Agreement between MedQuest, Ltd. and you concerning your use of this Website. Ultimately, this Agreement supersedes all prior agreements and understandings concerning the same.

18. Changes to these Terms and Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.

The content of this Website is not intended for use or distribution to any person or entity in any jurisdiction, geographical location, or country/state where such use or distribution will be contrary to the laws and regulations or subject MedQuest, Ltd. to any form of registration, claims, demands, costs, liabilities, damages, or expenses.

The Website is intended for users who are at least 18 years of age. If you are under the age of 18, you cannot use or register to use this Website or its services without parental permission or consent. By agreeing to these Terms and Conditions, you have the necessary legal capacity to comply and be bound by these Terms and Conditions.
